These Terms & Conditions (“Terms”, “Terms of Use”, or “EULA”) govern your access to and use of the Virtufy mobile application (“App”, “Service”). By downloading, accessing, or using Virtufy, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. About Virtufy
Virtufy is a fashion technology platform that enables users to:
- Virtually try on clothing using AI
- Manage a digital wardrobe and body profiles
- Receive personalized outfit recommendations
- Participate in a social fashion community
- Buy, sell, and host live sessions via an integrated marketplace
2. Eligibility
You must be at least 16 years old (or the minimum age required by local law) to use Virtufy. By using the App, you confirm that you meet this requirement.
3. Accounts & User Responsibilities
- You are responsible for maintaining the confidentiality of your account.
- All activity under your account is your responsibility.
- You agree to provide accurate and up-to-date information.
- Virtufy reserves the right to suspend or terminate accounts that violate these Terms.
4. User Content & Community Guidelines
You may upload content such as images, videos, and posts.
By uploading content, you grant Virtufy a non-exclusive, worldwide, royalty-free license to host, display, and distribute your content for operating the Service.
You agree not to upload content that is:
- Illegal, abusive, or harmful
- Infringing intellectual property
- Misleading or fraudulent
5. Marketplace & Live Features
Virtufy provides tools for sellers and creators to list products and host live sessions.
Virtufy:
- Is not a party to transactions between buyers and sellers
- Does not guarantee product quality or fulfillment
- Is not responsible for disputes between users
6. Subscription Plans (Auto-Renewable)
6.1 Available Plans
Virtufy offers the following auto-renewable subscription plans:
- Free Plan (no charge, limited features)
- Basic Plan – Monthly
- Pro Plan – Monthly
- Creator Plan – Monthly
Features vary by plan and are displayed in the App prior to purchase.
6.2 Pricing
Prices are shown clearly before purchase and may vary by region:
- Basic: $4.99/month
- Pro: $9.99/month
- Creator: $19.99/month
6.3 Auto-Renewal
- Payment is charged to your Apple ID at confirmation.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
- Renewal charges occur within 24 hours prior to the end of the billing cycle.
6.4 Managing & Canceling Subscriptions
Subscriptions are managed through Apple:
iOS Settings → Apple ID → Subscriptions → Virtufy
Deleting the app does not cancel your subscription.
6.5 Refunds
Payments are processed by Apple. Refunds must be requested via:
https://reportaproblem.apple.com
7. Body Scan & Virtual Try-On Disclaimer
Virtual try-on results and body measurements are estimates and may not perfectly reflect real-world fit. Virtufy does not guarantee sizing accuracy or purchasing outcomes.
8. Intellectual Property
All Virtufy software, branding, designs, and features are owned by Virtufy or its licensors and protected by intellectual property laws.
9. Termination
Virtufy may suspend or terminate access for violations of these Terms, misuse, or unlawful behavior. Paid subscriptions will not be refunded upon termination.
10. Disclaimer & Limitation of Liability
The App is provided “as is” and “as available.”
Virtufy shall not be liable for indirect, incidental, or consequential damages arising from use of the App.
11. Governing Law
These Terms are governed by the laws of US/ EU-compatible jurisdiction, without regard to conflict-of-law rules.
